The April 25 magnitude 7.8 earthquake which rocked Nepal has displaced thousands of Nepalese, leading Jeh Johnson, Secretary of Homeland Security, to assign Nepal as having Temporary Protected Status (TPS) for 18 months, effective June 24 2015. This means those Nepalese living in the U.S. who are eligible can apply for TPS with USCIS.
This means those eligible Nepalese will not be removed from the U.S. and can obtain an Employment Authorization Document (EAD) if they apply during the 18-month window. Applicants are considered eligible if they can show that they satisfy all necessary criteria including that they have been "continuously physically present" and "continuously residing" in the U.S. since June 24, 2015. Applicants will also need to pass security checks, and those with certain criminal records will be ineligible.
If you are unable to pay your TPS filing fees, they may be waived by filing Form I-912 or submitting a written request which must be accompanied by supporting documentation. All USCIS forms are free and can be requested by calling 1-800-870-3676.
