The Criminal Sentencing Phase

Once convicted, a defendant will face the sentencing phase to determine the appropriate punishment.

Criminal convictions can result in any of the following penalties:

  • Fines
  • Prison or jail time depending on the length of sentence
  • Probation
  • Suspended sentence if probation conditions are violated
  • Payment of restitution
  • Community service
  • Drug and alcohol rehabilitation

The sentencing will typically begin right away once convicted for infractions and lesser misdemeanors or when the convicted entered a guilty plea. Other cases such as serious felonies will take longer to reach a sentence: the judge will usually receive input from the prosecutor, the defense, and the probation department.

The sentencing judge will also consider punishments and sentencing ranges identified in applicable criminal statutes along with a number of case-specific factors.

Such factors include:

  • Defendant's criminal history
  • Nature of the crime, manner it was committed, any injuries, and impact on the victim(s)
  • Expression of any regret or remorse by defendant
  • Defendant's personal, economic, and social circumstances
