What is the Texas Tort Claims Act?

Enacted in 1969, the Texas Tort Claims Act waives sovereign immunity for governmental entities responsible for injuries caused during an act of governmental function. Prior to this act, government entities were immune to responsibility, which meant that individuals injured by government employees or other officers in an official capacity could not seek compensation for the damages they had suffered. While this type of immunity was originally thought to protect the government from wasted time, resources and overspending on defense in litigation cases, it left injury victims with nowhere to go to pursue the justice they deserved. Today, the Texas Tort Claims Act makes government entities liable for a variety of acts, including property damage, personal injury or wrongful death. Liability is limited to a maximum of $250,000 in monetary damages for each person, $500,000 for individual instances of bodily injury or death, and $100,000 for each individual case of destruction of property.
