Penalties for Multiple DWI Charges in Texas

Second DWI:

  • Time in jail for 1 month to 1 year
  • Fines up to $4,000
  • Suspended license for up to 2 years
  • Payment of $2,000 for 3 years to keep your license
  • Attendance at a DWI intervention or education course
  • Potential for Ignition Interlock Device installation

Third DWI:

  • Time in state prison for 2-10 years
  • Fines up to $10,000
  • Suspended license for up to 2 years
  • Payment of $2,000 for 3 years to keep your license
  • Attendance at a DWI intervention or education course
  • Potential for Ignition Interlock Device installation

For any additional DWIs, the penalties can vary. If you had a child in your car who was under 15 years old at the time of your arrest, you could automatically face up to 2 years in jail, fines up to $10,000 and license suspension for 180 days.
