About Robbery Charges

Under Texas Penal Code §29.02, "Robbery," occurs when the perpetrator "intentionally, knowingly, or recklessly" injures another person. It also occurs when the perpetrator places the victim in fear of imminent bodily injury or death. Robbery is charged as a felony of the second degree, which carries a possible sentence of between 2 and 20 years in state prison and a maximum fine of $10,000.

Penalty for Aggravated Robbery in Dallas

Robbery charges will under certain circumstances be increased to aggravated robbery, which under Texas Penal Code §29.03 is a felony of the first degree. Aggravated robbery is charged in cases where the perpetrator causes serious bodily injury to the victim or uses or exhibits a deadly weapon such as a firearm or a knife.

The charge also applies in robberies involving bodily injury or threats of injury or death to a victim who is either disabled or aged 65 years or old. A conviction for aggravated robbery is punishable by up to $10,000 in fines and between 5 years and life in prison.
