What Is Custody?

Texas does not use the term "custody" in the Family Code, instead custody is referred to as "conservatorship." Conservatorship means the rights of a parent to make certain decisions for his or her child; for example, where the child will live, where the child will attend school, and what medical treatment or procedures the child receives.

What Is Possession and Access?

In Texas, the term "visitation" is called "possession and access," which means the right to have actual possession of one's child on specific dates and at specific times. Ideally, the two parents will reach an agreement on conservatorship and the amount of time the child spends with each parent, assuming the agreement is in the best interests of the child. If the parents are unable to reach an agreement, then the judge will decide for them.

In most child custody cases, a child will live the majority of the time with the parent who is given the right to determine the child's place of residence. Regardless of the child custody arrangement, the court's goal is to ensure the child maintains a stable environment while encouraging an active and meaningful relationship with both parents.

Texas has basic guidelines for parents to consider in regards to possession and access (visitation) with each parent and the child. These guidelines provide for:
