What Does a Stay of Removal Actually Do?

The Stay of Removal does not mean that you will no longer be deported. Instead, it is merely a delay. In other words, the Stay of Removal imposes a pause in the deportation process, which gives you the chance to prepare a plan of action to resolve the situation and avoid the serious consequences of being removed from this country. If you are granted a Stay of Removal, you will most likely be placed on an Order of Supervision and may even be granted Employment Authorization so that you can continue to work.

When is a Stay of Removal Available?

In cases where the defendant in a deportation case files an appeal and has a pending action in the immigration courts, the person will often be granted an automatic Stay of Removal. It is also possible to petition the court for a discretionary stay based on evidence that it would be just and humanitarian to grant such relief. For example, the stay may be granted based on the fact that the petitioner is ill or is the primary caretaker for a U.S. citizen who is ill.

In other cases, the purpose of granting the stay may be to allow the immigrant to wrap up financial obligations and to make arrangements for family members who will be remaining in the United States.
