Using Temporary Protected Status to Avoid Deportation

If you can meet the strict requirements for eligibility, you may be able to claim temporary protected status (TPS) and thereby protect yourself from the risk of being deported / removed from the United States. Individuals who are granted TPS are not removable, but this is not the only benefit of this status. You can additionally obtain employment authorization so that you will be able to work and support yourself and your family, and you can even secure travel authorization, making it possible for you to enter and exit the United States without jeopardizing your immigration status.

What is temporary protected status?

The United States immigration legal system offers a special type of relief to foreign nationals who cannot safely return to their country of origin. Temporary protected status is essentially a humanitarian temporary immigration status that is available to those whose country of origin has been recognized as being unsafe or unable to handle the return of nationals. U.S. Citizenship and Immigration Services maintains a list of countries which have been granted TPS based on conditions such as ongoing armed conflict, environmental disasters or epidemics, or other extraordinary or temporary conditions. Currently, these countries include:

  • El Salvador
  • Haiti
  • Honduras
  • Nicaragua
  • Somalia
  • Sudan
  • South Sudan
  • Syria

Temporary protected status does not consist of an adjustment of status, so it is not a route to permanent resident status. Essentially, it allows the recipient to continue living and working in the United States for the duration of the status and without the liability of removal actions or detention. The status does not, however, preclude you from pursuing any other immigration status such as a nonimmigrant visa or a green card.
