What is Distracted Driving?

Distracted driving is defined as anything that pulls the driver’s attention away from the task at hand, either visually, physically, or mentally. In other words, whether something takes your eyes away from the road or simply pulls your thoughts away from driving, it is considered a distraction.

Texas Laws for Distracted Driving

While many states have outlawed cell phone use while driving all together, the laws in Texas for distracted driving are a bit more open, though complex. There is no hand-held phone ban, except in school zones, or for drivers under the age of 18. Additionally, school bus drivers must adhere to cell phone laws that prohibit any cell phone use when passengers are under the age of 18, or in school zones.

How Dangerous is Texting and Driving?

A study conducted by The Youth Risk Behavior Surveillance System revealed a staggering number of young people using their cell phones while driving. The highest proportion of distracted driving fatalities occurs in teenagers, and 2 out of every 5 high school students who drove in the past month sent at least 1 text while driving.

The number of deaths associated with texting and driving are devastating, though not surprising given the danger involved when a person texts while driving. A person looks at a text message for an average of 4.6 seconds, which, when driving at a speed of 55 miles per hour, would leave the driver’s eyes off of the road for the length of an entire football field.

Driving while using a cell phone may lead to fines between $200 and $500. However, if a distracted driver injures you in an accident, he or she may face common law negligence and could face more serious penalties.
