Filing a Divorce in McKinney

Collin County divorce cases are filed with the Collin County District Clerk. McKinney is the county seat, and district courts with family law dockets hear these cases in McKinney, including at the Russell A. Steindam Courts Building.

Before filing, at least one spouse generally must have lived in Texas for the preceding six months and in Collin County for the preceding 90 days. These requirements determine whether a case may be filed in Collin County.

Filing an original divorce petition starts the court case. Service of process, the formal delivery of legal documents, provides the other spouse with official notice of the filing.

Texas Divorce Grounds & the 60-Day Waiting Period

Texas permits a no-fault divorce based on insupportability under Texas Family Code Section 6.001. Insupportability means conflict has made the marriage unworkable and there’s no reasonable expectation that the spouses will reconcile. A spouse generally doesn’t need to prove misconduct to request a divorce on this ground.

Under Texas Family Code Section 6.702, a court generally may not grant a divorce until at least 60 days after the petition was filed. The mandatory waiting period begins on the filing date, not when the other spouse receives service of process.

A case doesn’t automatically conclude on day 60. Its duration depends on disputed property or parenting issues and whether the spouses reach an agreement.

Community Property & Property Division

Texas is a community property state. Community property generally includes assets and debts acquired during the marriage, although the circumstances surrounding particular property may require careful review.

Texas Family Code Chapter 7 directs courts to divide the marital estate in a manner that is “just and right.” That standard doesn’t require an automatic equal split. We assess the property issues presented by the marriage and develop a strategy around your circumstances and goals.

What to Expect from Our Divorce Representation

An attorney conducts your intake and remains directly involved through resolution. During the initial review, we examine your circumstances, discuss your priorities, and explain the legal rights relevant to your divorce.

We then develop a tailored strategy for the property, parenting, or support questions involved. Our legal team prepares the necessary paperwork, manages filings with the Collin County courts, and provides strategic guidance as the case moves toward an agreement or court resolution.
