What Is a Conservatorship?

A conservatorship is a legal arrangement in which a person or entity is appointed to manage the financial and/or personal affairs of another person. The person who is appointed to manage the affairs of the individual is known as the conservator. The individual who is being cared for is known as the ward or the protected person.

The main purpose of a conservatorship is to provide for the financial and personal care of the individual. A conservatorship does not provide the individual with the right to vote, drive, or make other important decisions. A conservatorship is not a form of estate planning or probate.

A conservatorship can be created in a variety of different ways. A conservatorship can be created through a court proceeding or by a living will or health care power of attorney. A living will or health care power of attorney can appoint a person to make decisions on behalf of the individual in the event that the individual is unable to make decisions for themselves.
