Obtaining a Release from Immigration Detention in Texas

When a foreign national is served with a Notice to Appear as part of a planned deportation / removal action, he or she must take action to resolve the situation and avoid the possibility of being processed for removal from the United States. In the event that the individual does not succeed in this, or fails to appear at the hearing, he or she will then be made subject to a removal order.

In cases where the individual violates this order, he or she may end up being arrested and held in custody by U.S. Immigration and Customs Enforcement (ICE). It is possible, however, to secure a release from custody and to lay the foundation for an effective deportation defense strategy with the use of an Order of Supervision.

How Can an Order of Supervision Help Prevent Deportation?

Orders of Supervision are normally used in cases in which ICE cannot yet carry out the proposed deportation and does not wish to hold the individual in custody. Very often, the decision to issue an Order of Supervision is based on some type of humanitarian grounds, such as if the person is a breastfeeding mother, is seriously ill, or is the sole caregiver for children who are U.S. citizens.

While the order is in effect, it is necessary to report in with the Enforcement and Removal Operations office on a regular basis in order to provide evidence that the person is actively working on obtaining a valid passport and a plane ticket for travel back to the country of origin.
