Guardianship Lawyer in Dallas, TX

Dallas Guardianship Representation Across the Full Range of Family Situations

Guardianship is a court-supervised legal process in which a judge appoints a guardian to make decisions for a person who cannot manage their own personal or financial affairs due to age, illness, disability, or cognitive decline. Texas courts approve guardianship only when no less restrictive alternative will adequately protect the individual, and state law requires an attorney to file and handle the case. At Mathur Law Offices, P.C., we represent individuals and families throughout Dallas and North Texas, including Denton County, in both contested and uncontested guardianship matters.

Our firm was founded by Mr. Sanjay Mathur on the principle that every client deserves top-tier representation. We provide direct attorney involvement and personalized strategies tailored to each family’s circumstances. Whether your situation is straightforward or involves competing interests among family members, we approach every guardianship matter with the same preparation and focus.

If your family is facing a guardianship situation in Dallas or Denton County, contact Mathur Law Offices, P.C. at (888) 867-5191 to speak with a guardianship attorney directly.

Guardian of the Person vs. Guardian of the Estate

Texas recognizes two distinct types of guardianship, and understanding the difference is essential when your family is deciding how to proceed.

Guardian of the Person

A guardian of the person is responsible for decisions about the ward’s day-to-day life, including housing, healthcare, educational decisions, and daily personal needs. This role covers the individual’s physical well-being and medical care.

Guardian of the Estate

A guardian of the estate manages the ward’s financial affairs, paying bills, managing assets, and making financial decisions on their behalf. This is a distinct role from child custody and conservatorship matters handled in family court.

Full & Limited Guardianship

Texas courts may create both types of guardianship in the same proceeding, and the same person can be appointed to fill both roles. A limited guardianship restricts the guardian’s authority to only those powers the ward cannot safely exercise independently, preserving the ward’s autonomy where possible. Temporary guardianship in Dallas County is capped at 60 days. Permanent guardianship continues until the ward regains capacity, passes away, or the court terminates the arrangement.

Who Can Be the Subject of a Guardianship in Texas?

Under Texas Estates Code Section 1002.017, an incapacitated adult is one who, because of a physical or mental condition, is substantially unable to provide food, clothing, or shelter for themselves, care for their own physical health, or manage their own financial affairs. Before granting any petition, the court must also find that no available alternative will adequately protect the individual.

Guardianship is commonly sought for:

  • Minor children who cannot care for themselves when parents are unavailable or incapacitated
  • Adults with serious disabilities or illness who cannot manage their personal welfare or financial affairs
  • Elderly family members with Alzheimer’s disease, dementia, or other cognitive decline that prevents safe independent decision-making
  • Special needs individuals turning 18, where parental authority ends and a legal guardianship is needed to continue protective oversight

Alternatives to Guardianship Texas Courts Require Families to Consider

Because guardianship removes legal rights from the ward, Texas courts prefer less restrictive options when they’re sufficient to meet the individual’s needs. Alternatives include durable power of attorney, medical power of attorney, supported decision-making agreements, special needs trusts, representative payee arrangements, and management trusts. When one of these tools adequately protects the individual, the court can favor it over a formal guardianship proceeding.

We provide personalized legal strategies and direct attorney involvement to help families evaluate which path fits their situation. When guardianship is the right course, we prepare the application and guide the process from filing through post-appointment obligations.

The Dallas County Guardianship Process, Step by Step

Guardianship petitions in Dallas are filed with the Dallas County Probate Courts at the George L. Allen, Sr., Courts Building. We’re familiar with the Dallas County Probate Court system and guide clients through each stage of the proceeding, including cases arising in Denton County.

The process typically involves:

  • Application: The application must identify the proposed ward, describe the basis for guardianship, list interested relatives, and specify whether the petition seeks guardianship of the person, the estate, or both.
  • Physician’s Certificate: A licensed physician must complete a Physician’s Certificate of Medical Examination confirming the proposed ward’s incapacity. The certificate must be dated within 120 days of the application filing.
  • Service and Notice: The proposed ward must be personally served with the application. Interested parties, including relatives, must also be notified.
  • Attorney Ad Litem: The court appoints an attorney ad litem. This is an independent lawyer appointed to protect the ward’s interests, not to represent the petitioner, and to participate throughout the proceeding.
  • Court Hearing: All parties and attorneys appear before the judge, who determines whether guardianship is necessary and who is suited to serve.
  • Letters of Guardianship: If approved, the county clerk issues Letters of Guardianship. The guardian must take an oath and post the required bond. In Dallas County, a guardian of the person posts a $100 cash bond; a guardian of the estate posts a separate bond based on the value of the estate.
  • Post-Appointment Obligations: Guardians must file annual reports and accounting documents with the Dallas County Probate Court. The court also appoints a visitor to check on the ward’s status periodically.
