Visitation: Possession & Access

Texas does not use the term visitation, instead it referred to as "possession and access." Possession and access is defined as the right a parent has to have actual possession of their child on specific dates and at specific times.

Since parents know their children better than anyone, it is best for the parents to reach an agreement concerning the time that each parent will spend with the child; however, such agreements are subject to the approval of the judge who decides if they are in the best interests of the child. If parents are unable to reach an agreement, then the judge will decide for them.

Standard Possession Orders

Usually, a child will live the majority of the time with the parent who has the legal right to decide the child's place of residence. It is the court's intention to maintain a stable environment for the child and to encourage a continuous relationship with both parents. With that being said, there are guidelines for possession and access with each parent and the child.

These guidelines provide for:

  • Weekends
  • Spring Break
  • Father's Day
  • Mother's Day
  • Thanksgiving
  • Christmas

The guidelines for possession times of the visiting parent are outlined in the "standard possession order," also known as the SPO. There are guidelines for possession and access for parents who live within 100 miles of each other and there is a separate set of guidelines for parties who live further away.
