Conservatorship, Possession & Access Under Texas Law

Texas law approaches parental rights through two distinct frameworks. Conservatorship refers to the legal authority to make major decisions about a child’s life, including education, health care, and religious upbringing. Possession and access refers to the physical schedule governing when each parent spends time with the child.

Texas Family Code section 153.002 establishes the best-interest-of-the-child standard as the governing principle in every conservatorship decision. Under section 153.003, courts evaluate parental rights without regard to the sex of the parent or the marital status of the parties. Under section 153.131, the law presumes that appointing both parents as joint managing conservators serves the child’s best interest. Sole managing conservatorship may be ordered when there is credible evidence of family violence, child neglect, or physical or sexual abuse, giving one parent exclusive decision-making authority. The other parent is designated the possessory conservator and typically retains a scheduled possession order.

Parental Rights Matters We Handle in Dallas

Parental rights disputes take different forms, and the legal path forward depends on the facts. Our attorneys represent parents in contested and cooperative scenarios alike, negotiating parenting plans and litigating when necessary before the George L. Allen, Sr. Courts Building in Dallas.

Custody Disputes in Divorce

When a marriage ends and children are involved, conservatorship and possession schedules must be established. If parents can’t reach a parenting agreement, Dallas County family courts apply the best-interest standard and may issue a Standard Possession Order setting out a default schedule for access and visitation.

Paternity & Unmarried Fathers

Unmarried fathers in Texas must establish legal paternity before asserting rights to custody, visitation, or parental decision-making. We handle paternity establishment and custody matters for fathers who want a formalized legal relationship with their child.

Termination of Parental Rights Defense

Termination proceedings, whether initiated by the state or another parent, carry the most severe consequence in family law: the permanent loss of parental rights. We represent parents defending against involuntary termination, working to protect the parent-child relationship.

False Allegations & Custody Conflicts

Allegations of abuse, neglect, or domestic violence raised during a custody dispute can significantly affect a case, and a focused legal response matters early. We represent parents contesting false allegations and working to counter their impact on conservatorship decisions.

Relocation Disputes & Custody Modifications

A parent seeking to relocate beyond the geographic restriction in an existing order must obtain the other parent’s written agreement or court approval. Under Texas Family Code section 156.101, courts may also modify a conservatorship or possession order when circumstances have materially and substantially changed and the modification serves the child’s best interest. We handle relocation disputes and modification proceedings for parents on either side of those requests.
