Which EB-3 Classification Fits the Position & Worker?

The offered position, its minimum requirements, and the worker’s education or experience must support the requested classification. Inconsistencies between the job requirements and supporting records can cause delays or raise concerns during agency review.

The three EB-3 classifications are:

  • Skilled workers: The offered occupation generally requires at least two years of training or experience, and the worker must meet those requirements.
  • Professional workers: The position generally requires at least a U.S. bachelor’s degree or a foreign equivalent, and the worker must possess the required degree.
  • Other workers: The position involves permanent, nonseasonal work that generally requires less than two years of training or experience.

A job title alone doesn’t establish eligibility. The employer’s actual minimum requirements, the position’s duties, and the worker’s credentials must align with the labor certification and immigrant petition.

How the Employer-Sponsored EB-3 Process Works

Most EB-3 cases begin with the sponsoring employer. Federal immigration and labor rules govern the process; Dallas doesn’t have a separate EB-3 procedure.

An EB-3 case generally moves through these stages:

  • Position planning: The employer identifies a permanent, full-time position and defines its duties and minimum requirements.
  • PERM labor certification: The Department of Labor uses PERM to test the U.S. labor market for the offered position. The process generally includes a prevailing wage determination, required recruitment, and an employer application documenting the results.
  • Form I-140 petition: After labor certification, the employer generally files Form I-140 with U.S. Citizenship and Immigration Services. The petition includes evidence concerning the position, the worker’s credentials, and the employer’s ability to pay the offered wage.
  • Permanent residence application: Once a visa number is available, an eligible worker in the United States may file Form I-485 to adjust status to permanent residence. A worker completing the process abroad generally proceeds through a U.S. consulate.

The sponsoring employer controls significant parts of the labor certification and petition process. The worker supplies education, employment, identity, and immigration records. We clarify these separate responsibilities and identify documentation concerns before they disrupt the filing strategy.

How Priority Dates Affect EB-3 Visa Availability

Approval of an immigrant petition doesn’t necessarily allow the worker to complete the green card stage immediately. Visa availability depends on the worker’s priority date, country of chargeability, subcategory, and the applicable Department of State Visa Bulletin.

A priority date establishes the worker’s place in the immigrant visa queue. Skilled workers and professionals share one set of cutoff dates, while the Other Workers category has separate dates. Those dates may advance, remain unchanged, or move backward from one Visa Bulletin to the next.

Agency workloads, requests for evidence, recruitment concerns, document issues, and shifts in visa availability can also affect a case. Filing decisions should reflect current rules and updates from the Department of Labor, U.S. Citizenship and Immigration Services, and Department of State.
