Adjust to Legal Permanent Resident Status

The Department of Homeland Security reports that there were a total of 1,062,040 people granted legal permanent resident status in 2011. Of these green cards, 580,092 were granted through the process of adjustment of status. There are two routes for obtaining a green card: consular processing, in which a foreign national applies at the U.S. Embassy or Consulate in his or her country of origin; and adjustment of status, which is available to certain foreign nationals who are already present in the U.S. on a nonimmigrant visa.

Eligibility for Adjustment of Status

Eligibility for adjustment of status is based on being in one of several different immigration categories. In most of the cases which approved by U.S. Citizenship and Immigration Services, the applicant submits his or her petition on a family-based visa - either in the immediate relative visa category or with one of the family preference visas - or on an employment-based visa.

In both cases, the petitioner must be sponsored, either by the permanent resident or U.S. citizen relative or by the prospective or current employer. In the latter case, it is often necessary for the employer to first obtain labor certification to ensure that the hiring of foreign nationals will not deprive local workers of jobs or depress local wages. In addition to employment- and family-based immigrant applications, adjustment of status is also available for asylum seekers and for certain special classes of immigrants.
