Convention Against Torture

About the United Nations Torture Convention

For individuals who are in the country illegally and are attempting to obtain legal status through the Convention Against Torture, Article 3 of the United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment Act (CAT), a Dallas immigration attorney may be able to assist you in applying for asylum under this act. Any person may be eligible for this asylum under CAT, as this is a treaty between countries explicitly prohibiting the return of a person who may be subjected to torture if returned to their native country.

Although this is a difficult case to win, if an individual can prove that there is a strong likelihood of their being tortured if they were to be returned to their home country, they may qualify to remain in the United States or be removed to another country that will accept them. If you are granted protection under CAT you are not entitled to become a permanent resident and obtain a green card, but you may qualify to apply for an employment authorization, allowing you to reside and work legally in the United States.

Consult With a Dallas Immigration Attorney

Being subjected to the possibility of torture if returned to your native country can be a horrifying situation to be in. If you or a loved one finds yourself in this circumstance, consulting with an experienced immigration lawyer would be crucial to your future. Taking the legal step to legitimize your stay in the United States due to impossibly difficult conditions at home could lead to a safer and saner future for you and your family. Not having to worry about the possibility of being deported and subject to unspeakable acts against you can greatly affect your ability to enjoy your life.
